Section 1: Introduction, Purpose and Authority
These Rules govern the use of the Common Areas within the Lonesome Dove Subdivision
(River District HOA), specifically Common Lot 1, Common Lot 20, and Common Lot 11
of Block 9, situated in the Subdivision, which is located in Ada County, Idaho and shown
in Figure 1 below. It also applies to other HOA owned Common Areas, as specifically
described herein. It does not apply to the HOA clubhouse and pool/hot tub areas, or to
Phase 2 (i.e., Cadia) Local or Limited Local Common Areas.
The primary aim of these rules is to facilitate the appropriate utilization and enjoyment
of the communal spaces within the River District HOA, in a way that promotes the safety
of all users.
These Rules and Policy are established pursuant to the authority granted to the HOA in
Article VIII, Section 9(A)(1) of the Declaration of Covenants, Conditions, Easements and
Restrictions for Lonesome Dove Subdivision (“CC&Rs”) which provides that the Board of
Directors of the HOA shall have the power to “[a]dopt and publish rules and regulations
governing the use of the Common Area and facilities, and the personal conduct of the
Members and their guests thereon, and to establish penalties for the infraction thereof.”
Section 2: Pond CAUTION
Please be aware that chemicals are regularly added to the ponds for aquatic plant control.
Additionally, due to large numbers of birds and wildlife in and around the ponds, high
levels of Escherichia coli (E. coli) are generally present in and around the ponds. Pond E.
coli levels are not monitored, so in-pond activity (e.g., wading) is strongly discouraged
and is at one's own risk.
Pond activity, except for fishing, is not monitored and no lifeguards are present. The HOA
shall in no way be held liable or responsible for Member or guest’s use of the ponds or
Common Areas.
Section 3: Access to Common Areas
These Rules address use and enjoyment of the Common Areas by the following groups:
● HOA Members and Residents1 (hereinafter Members/Residents);
● Member-/Resident-Invited Non-Resident Family Members (hereinafter
Non-Resident Family Members); and
● Member-/Resident-Invited Guests (hereinafter Guests).
3.1 Members/Residents, including all individuals who reside in the HOA, shall have
full access to Common Areas, subject to applicable rules.
3.2 For the purposes of this policy and rules document, Non-Resident Family
Members shall include a Member’s or Resident’s:
● Parents and grandparents;
● Children and grandchildren (biological, adopted, or stepchildren);
● Siblings (brothers and sisters, including step- and half-siblings); and
● Aunts, uncles, nieces, and nephews.
Non-Resident Family Members are welcome to use the HOA Common Areas
without being accompanied by the resident, provided that:
● The Non-Resident Family Member has been explicitly invited by a
Member/Resident;
The Member/Resident remains responsible for the Non-Resident Family
Member’s conduct, in conformance with HOA rules, and any damages
caused by the Non-Resident Family Member; and
● Non-Resident Family Members comply with all HOA rules and regulations
applicable to Common Area use.
